The Board of Certified Advanced Estheticians

(Board), met on December 14 to adopt perma-

nent and temporary rules.

Permanent Rules Adopted:

Due to ex-

tensive public comment and confusion about

the process of rulemaking, the Board adopted

permanent rules ONLY for definitions and fees

as well as repealing rules related to grandfather-

ing. All other rules filed as proposed, in October

2017, that were intended to be filed as NEW

ADOPTED rules are being filed as temporary

rules which are valid for 180 day period this

will allow stakeholders and interested parties

engage in the rulemaking process. Temporary

rules are valid from January 1 to June 29, 2018.

Several rules originally proposed have been

amended for the temporary rules. Amendments

are as follows:

• Remove of chemical peels from curriculum

and scope of practice – which is under fur-

ther review regarding lawful inclusion;

• Add NONABLATIVE to skin needling;

• Remove requirements for client disclosure

forms with the exception of the require-

ments listed in ORS 676.655(2)(b) – disclo-

sure of whether or not the advanced esthe-

tician has professional liability insurance;

At the October 30, 2017 meeting the Board of

Cosmetology (Board) approved a 2018 rulemaking

schedule; However due to the continued need to

review the advanced esthetics program rulemak-

ing for the Board of Cosmetology has been put on

hold until the Fall of 2018. The Board will likely ap-

prove a new rule schedule at the June 11 meeting.
