In describing how to establish a line between basic and advanced esthetics, Board of Cosmetology Chair Debora Masten says that “All we have to do is part the waters.”
But do we need to reinvent the wheel?
While help from above was necessary for Moses to part the Red Sea, the job of creating a specialty certification for advanced esthetics won’t necessarily require a miracle, just hard work.
At the initial meeting leading to advanced esthetics administrative rulemaking on March 13, Masten and fellow Legislation/Rules Committee members began the process of determining what advanced esthetics will look like in Oregon.
Audience members asked the committee to consider existing models from other states and organizations as well as an advanced esthetics curriculum already approved by the Department of Education, Private Career Schools.
The committee and board are scheduled to continue addressing the issue through July 1, when the public comment period for proposed advanced esthetics administrative rules opens.

The Board of Cosmetology is in the first phase of administrative rulemaking. Often during this time public comment is not taken in an effort to prepare for the second phase of administrative rulemaking.
Once the board approves proposed Oregon Administrative Rules (OARs), the rules are filed with the Secretary of State. The proposed date for filing proposed rules is July 1, 2010, at which time the public comment period begins. During this time written comments will be accepted.
The public comment period will close as of July 30, 2010, giving interested parties 30 days to comment. On July 30, 2010, the Oregon Health Licensing Agency and board will hold a public hearing where oral testimony will be received by a contracted hearings officer.
The board will review and consider all comments and recommendations at the full board meeting on August 27, 2010 (conference call), to adopt fees and November 8, 2010, regarding all other rulemaking. Please send all comments to:

Is the public or licensees allowed to attend the Rules Advisory Committee meetings?
Yes. Members of the public are invited and encouraged to be in attendance at all board committee meetings. However, this does not mean the committee will allow for participation from audience members under Attorney General’s Meeting Manual ORS 192.630. Committee members may opt to call on subject matter experts (SME) for knowledge in specific areas. Decisions to call on SMEs will be made by the board members at the time of the meeting.

Question: Do you have online schools and what are their requirements?

Answer: No. However, the Oregon Health Licensing Agency (OHLA) has approved online continuing education courses for other OHLA-regulated professions.
At the advice of agency legal counsel, OHLA no longer offers fitness-to-practice preauthorization to individuals who have yet to obtain qualifications for certification. Visit http://egov.oregon.gov/OHLA/COS/Features/Tools_for_Schools.shtml for the memo to cosmetology colleges.
In response to an inquiry from a facility owner regarding the FIT body wrap, OHLA requested clarification from agency legal counsel on the system as well as the related position statement adopted by OHLA and the Board of Cosmetology on 1/12/09 allowing unregulated services in licensed facilities if health and safety requirements are followed.
While stating that “A safe answer would be that OHLA does not regulate fit body weight loss wraps,” the advice notes that the 1/12/09 position statement is fine as a statement of agency and board policy.
