You may recognize the barber shaving a customer on the cover of the new Texas Barbers Laws and Rules book, it is long-time Austin barber Roosevelt Stewart, better known to his clients as Bubba. By September 1, 2008, Mr. Stewart will be in barber shops and schools across the state, at least his picture on the cover of the new Laws and Rules book will be.
Licensed barbers are encouraged to keep up to date with new laws and rules by purchasing the latest edition. To order your book simply fill out the order form included in this issue of Texas Stylist or download the form from the barber web pages on the TDLR web site at http://www.license.state.tx.us/barbers/forms/010bar.pdf.
When filling out the order form please include your correct mailing address and e-mail address so we can send you updated information when necessary. Please remember to include a money order or cashier check for the book.
Barber Administrative Rule 82.72 (e) specifies, “A barber school shall furnish each student within seven days of the student’s enrollment his or her own copy of the law and rules book published by the department. Each student shall retain permanent ownership of the books so that he or she will have ready access to and be knowledgeable of the laws and rules that regulate barbering.” In plain language the rule states the barber school will provide each new student a copy of the Laws and Rules book within seven days of enrolling in the school.

The newest edition of the Texas Cosmetology Law and Rules Book is available for purchase. Whether you refer to it by the color of its cover: pink book, blue book, orange book or call it the Law and Rules book, by September 1, 2008, the new book must be purchased from the Texas Department of Licensing and Regulation (TDLR) and in the possession of independent booth licensees, salons and schools.
To stay current on new cosmetology law and rules Cosmetology Administrative Rule 83.71 requires every beauty salon, specialty salon, dual shop and booth rental license holder (independent contractor) to have a current copy in their possession. We encourage all cosmetologists and specialty license holders to have a copy of the law and rule book also.
Cosmetology students receive the latest edition when they apply for a student permit. Schools fall under Rule 83.72, and are required to have a copy of the current law and rules book on site.
To order a new book visit TDLR’s website: www.license.state.tx.us and click on the cosmetology page. Under the heading “Inside Cosmetology” you will find the link for cosmetology forms. You may complete the form, print it and mail it with your cashier check or money order, $14 for each book ordered, to:

Remember, it is a Rule that you have your copy by September 1, 2008, so get it while it is hot off the press!
Chimneys have their sweeps, television channels have May sweeps, and the Texas Department of Licensing and Regulation has license sweeps. TDLR investigators perform sweeps to find unlicensed activity being performed across the state.
When a TDLR investigator conducts a sweep the salon or shop involved shouldn’t confuse it with your regular inspection. The main reasons for the license sweeps are to check all licenses and make sure people working in the industry have a current license.
Do not get swept up in one of TDLR’s license sweeps; check the date on your license and make sure to renew it before it expires. The fastest and easiest way to renew your license is through TDLR’s online license renewal system. Go to the TDLR home page at www.license.state.tx.us and click on “Online License Renewal and Applications.”
To help you keep your license current the Texas Department of Licensing and Regulation sends notification to the license holder when their license is expiring but sometimes that notice does not make its way to the licensee. This can come about if an individual moves and does not file a change of address with TDLR.
Whether or not a cosmetologist or barber receives a renewal notice, the licensee is responsible for renewing their license on time. If your license expires before you send in your renewal payment late fees will make your license fee higher and if it is a year past your expiration date you will have to retest to obtain your license.
Even if you have not completed all required continuing Education (CE) hours, file your renewal anyway. Your license will not be issued until the CE hours are completed, but you will not be charged a late fee if you file before the expiration date.
We thought it would be interesting to look at both the cosmetology and barber populations since the programs were transferred to Texas Department of Licensing and Regulation (TDLR).
As you can see there are changes in some of the numbers. For instance, the total number of licensed barber students declined from 9,967 in May 2006, to 2,434 in May 2007. An examination of the records found duplications or incorrect information. For example, some practicing Class A barbers were still listed as a student in the old information. A general clean-up of the information gives a clearer picture that barber numbers are on the rise.
Special note should be made when looking at cosmetology numbers; these numbers do not include licenses put on inactive status. Also keep in mind between May 2006 and May 2007 the continuing education requirement for license renewal was initiated and many retired cosmetologists let their license expire rather than take the continuing education courses.
