NEW BUSINESS
Continued Education: Jerry Gardner, Elite CME, Inc. Vice President, discussed continuing education in the cosmetology, manicure, barber and esthetics fields. He stated that Elite’s 8-hour program is recommended for every two years covering four hours dedicated to health & sanitation, laws and rules; the other four being service oriented. Elite has four different venues for taking their course. He explained the benefits and disadvantages of all four venues as well as the expense for the program.
MRSA: Susan Colard explained the symptoms and dangers of MRSA in our community and profession. She reported that the Department of Licensing is taking steps to establish relationships with Department of Health and the Communicable Disease Epidemiology & Immunization Section, Division of Infectious Diseases, at the University of Washington. The Department of Licensing will be working with the Public Health Department to establish a pilot program to test for MRSA when an infection is reported.
Trudie Touchette presented photos of a beauty school that was instructed to close the doors for any business purposes until further notice. The school was found to have safety and sanitations violations that would present immediate danger to the public. The school was able to pass inspection and was approved to re-open for business.
Trudie wanted to reiterate that it is not the intention of the Department to prevent schools from functioning and making money but to protect the public and make sure the students are being taught sound practice that will prevent the spread of disease and harm to the public.
Legislative Update: Apprenticeship Bill passed through the senate and rules and is pending Governor Gregoire’s signature. The main change in the bill was the reduction of hours for Esthetics from 2000 to 800 hours and Cosmetology was reduced from 3000 to 2000 hours. The new legislation also adds a representative for apprentices on the Cosmetology Advisory Board.
Anne Martin and Gary Howse expressed their concern over the reduction in hours.
Trudie encouraged the Board and interested stakeholders to attend the legislative hearings to voice any concerns.
Update on DOH Non-Surgical Medical Cosmetics Procedures: Anne Martin reported on a meeting she had attended with DOH regarding Non-Surgical Medical Cosmetic Procedures.
She had a concern about the broad language Department of Health is proposing stating anything that severs or penetrates the Stratum-Corneum should be regulated. This includes water, chemicals, etc and would greatly affect Esthetics.
The Medical Quality Assurance Commission (MQAC) was informed of the impact the proposed language would have on the Esthetics profession. They indicated their intent was not to regulate the Esthetics profession and they will propose a third draft that will not include the Stratum-Corneum; in addition they will change the title to Non-Surgical Medical Cosmetic procedures and add “prescriptive” to the language.

Mike Kennard, Bellingham & Yakima Beauty Schools, expressed his concern over the exam facilities having no representation/oversight from the Department. He also expressed concern over the current appeal process and how it delays the re-examination for a month. He believes there needs to be an immediate application for re-exam process.
Darryl Camp, NW Hair Academy, Everett/Bellingham, believes that it should be the responsibility of the college if a student doesn’t pass an exam. He supports having a timely recourse for a non-passing score and a better appeal process. He is requesting that the Board look at the issues regarding inspect vs. aspect of exams and recourse time.
Troy Amundson, Professional Body Piercer, would like the Board to consider increasing the hours of training on Blood Borne Pathogens. He explained that it is needed to have at least four hours of training each year on this topic. He would like to provide some information on MRSA.
Kim Davis-Lima, Bellingham Beauty School, expressed her concerns about not being told what subjects the students are failing in the exams only the points they are missing by. She expressed the concerns about the treatment of the students by the instructors and the fairness of the exams and how they are not being administered without oversight.
Jerry Ahern, Gene Juarez Academy, expressed the confusion about how quality is not factored into the grade for shaving on the practical exam. He mentioned that 67% of the exam is not in the scope of safety and sanitation requirements but the law is based on these factors.

Remember!
If there is more than one color of hair on the floor at a station, the Department of Licensing inspector will consider this a violation. Workstations, floors, walls, fixtures, and ceilings must be free from dust, dirt and hair. The law requires licensees remove all hair from the floor and workstation after each service. Hair can get in your lungs, or your customers, and can attach itself to your feet if you wear sandals. Take good care of yourself, your fellow coworkers, and customers by cleaning after each service!
